What Are the Requirements for a Green Card?
Each year there are a limited number of visas given out to individuals who want to become permanent residents of the United States, via a family sponsor, job opportunity, or special circumstance such as asylum.
Current requirements for becoming a permanent resident of the U.S. include:
- Eligibility in one of the immigrant categories established by the INA
- A qualifying immigrant petition, from an employer or family member
- An immigrant visa that is immediately available
- The capability of being admitted into the United States
How Long Does It Take to Get a Green Card?
The process to get a green card can be a long, complicated, and very frustrating. The longest waiting period during this process comes during the petition phase, which can be anywhere from a few months to 10 years, as opposed to the visa approval phase, which takes only a few days to a few weeks. The amount of time depends of the type of green card an individual is applying for.
Common wait times for green cards are:
- Immediate Relative Green Cards: within a few months
- Diversity Green Cards: within seven months
- Employment-Based Green Cards: one to four years
- Family Preference Green Cards: one to ten years
